Normative change facilitates participation of foreign companies in bidding
The Ministry of Economy published the Normative Instruction nº 10, which allows foreign companies to participate directly in bids in Brazil, without the need for a national representative. With this new rule, the requirement for a local partnership (with an individual or legal body) at the time of registration for dispute will cease to exist.
As of May, 11 this requirement will only be maintained if the foreign company wins the bid. According to the government, this action is part of a series of measures to open the bidding Market and is in line with the requirements for adherence to the Government Procurement Agreement (GPA) of the World Trade Organization (WTO).
It is believed that this measure will bring more competition to the bidding market, by facilitating the entry of international suppliers in bidding processes for goods, services and works.
