The National Land Transport Agency (ANTT) launched two public consultations on the improvement of the regulatory framework related to highway concession contracts, regarding amendments to the rules of recomposition and new guidelines for rebidding. They seek to increase transparency, predictability and legal certainty.
Public Audience n. 5/2020 from the National Land Transport Agency (ANTT) aims at collecting public contributions to a draft resolution on new guidelines for closure and rebidding of highway infrastructure concession contracts. Since those guidelines are currently provided on an individual base, contract by contract, ANTT seeks to regulate a general provision in order to improve transparency, predictability and legal certainty.
While the public hearing was already held on November 26 (recorded session available here, in Portuguese), contributions can still be submitted until December 17. The draft resolution, a technical note and instructions for participation are available at the consultation’s website (in Portuguese).
Public Audience n. 7/2020 from the National Land Transport Agency (ANTT) seeks to collect public contributions to an amending proposal to the contract recomposition rules, provided by ANTT Resolution n. 3.651/2011 and ANTT Resolution n. 5.859/2019.
The amending proposal’s goal is the improvement of governance mechanisms and the removal of normative conflict between the valid resolutions.
The public hearing is scheduled for January 7, 2021 and contributions can be submitted until January 17, 2021. The draft resolution, a technical note and instructions for participation are available at the consultation’s website (in Portuguese).
