The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) launched a public consultation on a draft resolution intended to update the E&P safety supervision framework. The revision, which comprises ANP’s 2021-2022 Regulatory Agenda, aims at improving regulatory clarity and efficiency.

Public Consultation n. 4/2021 from the Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) seeks to collect public contributions on a resolution proposal to replace ANP’s E&P safety supervision rules, provided by ANP Resolution n. 37/2015. According to ANP, the revision is designed to improve regulatory clarity and eliminate low impact requirements.

The proposed revision for the safety supervision rules, related to operation audits and the assessment of non-conformities, include the clear definition of non-conformity levels of risk; the elimination of document submission requirements related to the proof non-conformity mitigation, in favor of a request approach (of that proving document); and the revision of the procedures for verifying non-conformity mitigations.

Contributions can be submitted, through this form, until May 24. A public hearing will be held on June 16 (registration available through this form).

The E&P safety supervision framework revision is part of ANP’s 2021-2022 Regulatory Agenda and was the subject of an ANP workshop (recording available here, in Portuguese). The draft resolution, technical notes, and more information are available here (in Portuguese).
