The Foreign Trade Chamber (CAMEX) at the Ministry of Economy consolidated and updated the regulatory provisions of the regime of auto-parts not produced domestically, which grants import tariff benefits to qualified automotive companies.



The Foreign Trade Chamber (CAMEX) at the Ministry of Economy enacted two resolutions that consolidated and updated the regulatory provisions of the regime that grants import tariff benefits to qualified automotive companies for importing specific auto-parts not produced domestically. The regime comprises two frameworks:

  • The “reduction” system under the 38th additional protocol to the Economic Complementation Agreement n.º 14, which establishes 2% import tariff rates to auto-parts treated as the “ex-tariff” regime, i.e., as capital goods (BK) or computer and telecommunication goods (BIT); and
  • The “exemption” system under Law n.º 13.755/2018 and Decree n.º 9.557/2018 (Rota 2030 program), which exempts specific auto-parts that comprise the program.

GECEX Resolution n.º 284/2021 consolidated 19 resolutions from the “reduction” system into a single resolution. The benefited auto-parts are listed in Annex “I” (BK auto-parts) and Annex “II” (BIT auto-parts). The list is also available on CAMEX’s website. The “reduction” system currently covers 3,694 products under 322 tariff lines (Mercosur Common Nomenclature codes – “NCM” codes, in the Portuguese acronym). 3,431 of them are BK auto-parts and 263 are BIT auto-parts.

GECEX Resolution n.º 285/2021 consolidated 15 resolutions from the “exemption” system of the regime for auto-parts not produced domestically into a single resolution. The list is also available on CAMEX’s website. The “exemption” system currently covers 1,190 products under 211 NCM codes.

Furthermore, the Ministry of Economy launched the National Observatory of Industries for Mobility and Logistics (available here), a digital platform designed to present data and qualified information on the Brazilian automotive industry. According to the ministry, the platform, which is provided by Law n.º 13.755/2018 (Rota 2030 program), will publish qualified information regarding the Rota 2030 program and Priority Programs as of March 2022.
