The Brazilian Electricity Regulatory Agency (ANEEL) launched a public consultation intended to survey the public opinion on the liberalization of the electricity market, through the availability of the Free Contracting Environment (ACL, in the Portuguese acronym) to all levels of demand by 2024. Contributions will support a report on the necessary regulatory measures.



The Brazilian Electricity Regulatory Agency (ANEEL) launched Public Consultation n. 10/2021 as a means to survey the public opinion on the liberalization of the Free Contracting Environment (ACL, in the Portuguese acronym) for electricity trading, which will be available to consumers with less than 0.5 MW in electricity demand by 2024, as provided by Ordinance n. 465/2019 from the Ministry of Mines and Energy (MME). The liberalization comprises the Federal Government’s Electricity Sector Modernization program, designed to foster market competitiveness, while guaranteeing systemic stability and consumer protection.

The ACL is the market for electricity trading that allows consumers to choose their electricity suppliers and commercial conditions, contrary to the Regulated Contracting Environment (ACR, in the Portuguese acronym). According to ANEEL, circa 35% of the total electricity consumption within the National Integrated System (SIN, in the Portuguese acronym) is carried out through ACL, and that participation is expected to increase.

The public consultation aims at collecting public contributions on the liberalization process, which will support the elaboration of a report, to be submitted to MME, on the regulatory measures necessary for the implementation of the liberalization process, scheduled to be initiated on January 1st, 2024.
