The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) enacted new rules for E&P investment obligations in RDI activities. They comprise company programs in priority segments and the prioritization of specific topics of innovation.
The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP), through Resolution n.º 866/2022, amended ANP Technical Regulation n.º 3/2015, which regulates E&P investment obligations in Research, Development, and Innovation (RDI) activities. The update stems from Public Consultation and Audience n.º 13/2021, reported in the 27th edition of the Regulatory Report.
The revision was twofold. It revised specific provisions as a means to improve the efficacy of RDI investments obligations and expanded the set of RDI activities that may receive such investments. Concerning RDI activities, the resolution established new provisions on energy transition and renewable energy, a new entrepreneurship program for startups in priority segments, a new program for micro, small and medium-sized suppliers, and the prioritization of RDI investments within the topics of federal interest provided by Resolution n.º 2/2021 from the National Council for Energy Policy (CNPE) – reported in the 22nd edition of the Regulatory Report.
