The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) launched a public consultation on a draft resolution establishing the criteria for independence and autonomy of natural gas transport activities, for a period of 45 days. The new resolution aims at guaranteeing a competitive market for the natural gas industry.



Public Consultation and Audience n. 18/2020 of the Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) presented a draft resolution providing the criteria for independence and autonomy of natural gas transport activities.

The new regulation is in line with the New Gas Market program, follows the directives of the Nacional Council of Energy Policy (CNPE, in the Portuguese acronym), through its CNPE Resolution n. 16/2019, and is a part of ANP’s 2020-2021 Regulatory Agenda. It aims at guaranteeing a competitive market for the natural gas industry, by providing the complete separation of the transportation activity from other potentially competing supply chain activities.

The draft resolution provides the complete separation of property between transport agents and agents operating in potentially competing activities within the natural gas supply chain. It also provides the application of “independence certificates” of transport operators, who may opt between complete separation of property and acting as an “independent operators” within the natural gas transportation system. 

The public consultation was exempted of a Regulatory Impact Analysis, as provided by the technical note.

The public hearing is scheduled to January 26, 2021.
