The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) submitted a preliminary regulatory outcome analysis of ANP Resolution n.º 795/2019 to public consultation, concerning the transparency obligations applicable to producers, importers, and distributors of oil products.
The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) submitted a preliminary regulatory outcome analysis (ARR, in the Portuguese acronym) to public consultation, concerning the regulatory impact assessment of ANP Resolution n.º 795/2019, which enacted transparency obligations applicable to producers, importers, and distributors of oil products, related to prices and contract conditions.
The preliminary ARR recommends the amending of the aforementioned resolution, as a means to improve the current transparency mechanisms, which are intended to mitigate information asymmetry within the market, safeguarding consumer interests. The current mechanisms include the publicization of list prices applied in the previous 12 months (chapter “II”); contractual provision of indicative prices (chapter “III”) – whose revision is recommended by the ARR –, and submission of information related to freight costs and unitary prices to ANP (chapter “IV”).
The public consultation seeks to collect public contributions to the ARR and the resolution under assessment. The conclusion of the ARR with an amendment recommendation will entail a new public consultation process.
