The Ministry of Economy, as part of its FIARC program (Intensive Front for Regulatory and Competition Assessment), launched two public consultations on the regulatory frameworks for the AFRMM navigation tax, and for interstate charter passenger transportation. They are designed to assess market competition and regulatory abuse.



The Ministry of Economy launched two public consultations related to the FIARC program (Intensive Front for Regulatory and Competition Assessment – FIARC, in the Portuguese acronym), which is designed to address market competition and regulatory abuse. The public consultations cover the regulatory frameworks on the AFRMM navigation tax (Freight Surcharge for Renewal of the Brazilian Merchant Marine – AFRMM, in the Portuguese), and on interstate charter passenger transportation.

As reported by the 17th edition of the Regulatory Report, the FIARC program was established by the Ministry of Economy in order to counter regulatory abuse, defined by article 4 of the Law of Economic Freedom (Law n. 13.874/2019). The program is now assessing the regulatory framework on the AFRMM tax, applicable to cabotage and long-distance navigation, and the regulatory framework on interstate charter passenger transportation.

The public consultation on the AFRMM tax can be accessed here, where contributions can be submitted until May 16. A public hearing (Public Audience n. 1/2021) will be held on May 26. More information is available here. Additionally, Public Call n. 1/2021 was launched to collect technical opinions on Decree n. 5.269/2004 – contributions can be submitted until June 12.

The public consultation on interstate charter passenger transportation can be accessed here, where contributions can be submitted until May 16. A public hearing (Public Audience n. 2/2021) will be held on May 25. More information is available here. Additionally, Public Call n. 2/2021 was launched to collect technical opinions on Decree n. 2.521/1998 and National Land Transport Agency (ANTT)’s Resolution n. 4.777/2015 – contributions can be submitted until June 12.
