The Ministry of Economy opened two public consultations for the elaboration of Normative Instructions for accelerating and resuming the economy through the transformation of Brazilian regulatory environment
Public Consultation n. 01/2020 presents the Intensive Front of Regulatory and Competitive Evaluation (Fiarc, in the Portuguese acronym), that establishes parameters through which the Secretariat of Competition and Competitiveness Advocacy will exert its competence in proposing normative changes in regulations. The criteria and requirements that will guide this effort were designed based on the idea of regulatory abuse, present on the Economic Freedom Act, and on nine situations of potential distortions in competition.
Public Consultation n. 02/2020 establishes the assessment policy for regulatory relief as an additional element within Seae’s capacities. The proposal establishes guidelines, using criteria to assist the Secretariat in its competence to reduce business costs in Brazil. The Normative Instruction establishes five criteria to assess regulatory burden as an anti-competitive element: regulatory obligations, technical specifications, regulatory restrictions and prohibitions, licensing and regulatory complexity. The Secretariat of Competition and Competitiveness Advocacy at the Ministry of Economy (Seae/ME) expects to collect contributions until August 17, 2020, via the institutional e-mail seae@fazenda.gov.br .
