The National Agency for Waterway Transportation (ANTAQ) submitted to public consultation a proposal to establish an auxiliary dispute settlement mechanism to facilitate the conciliation between economic agents under ANTAQ regulation, involving port and navigation services.



Public Audience n.º 2/2022 from the National Agency for Waterway Transportation (ANTAQ) intends to collect public contributions on a normative instruction proposal that establishes an auxiliary dispute settlement mechanism within ANTAQ, designed to facilitate the settlement of disputes between economic agents under its supervision. The proposal stems from ANTAQ’s 2020-2021 Regulatory Agenda (item 4.1), seeking the standardization and improvement of transparency related to dispute settlement activities.

As stated in the second article of the proposal, the dispute settlement procedures are designed to facilitate the conciliation between companies, users, and other regulated entities involving port services, interior navigation services, maritime navigation services, chartering, and regulatory disputes (see article 8). Chapter “II” (articles 4 to 8) provides the conditions for the establishment of the auxiliary ANTAQ dispute settlement, while chapters “III” to “V” (articles 9 to 42) provide its rules across the different types of disputes.
