The National Agency for Waterway Transportation (ANTAQ) updated the criteria and procedures for inland navigation chartering, applicable to domestic and foreign shipping vessels. Brazilian Navigation Companies (EBN, in the Portuguese acronym) must follow those procedures for chartering foreign vessels.



Resolution n. 41/2021 from the National Agency for Waterway Transportation (ANTAQ) replaced ANTAQ Resolution n. 1.864/2010, updating the criteria and procedures for chartering vessels destined for inland navigation, applicable to both domestic and foreign shipping vessels.

The resolution provides that foreign vessels can be used for inland navigation (with national or international routes), if chartered by a Brazilian Navigation Company (EBN, in the Portuguese acronym) and, when applicable, if authorized by ANTAQ. The specific criteria for foreign vessel chartering destined for inland navigation are provided in articles 6 and 7.

The chartering process is carried out within ANTAQ’s Chartering Management System (SAMA, in the Portuguese acronym), where an EBN (charterer) can submit requests for shipping vessels, following the procedures specified in the resolution. When a request is not fully or partially contemplated by domestic vessels, the charterer may request for foreign vessels.

When an ANTAQ authorization is required, the charterer must provide an authorization request (article 15) and,
if approved by ANTAQ, an Inland Chartering Authorization Certificate (CAAI, in the Portuguese acronym) is enacted. More details are available in the resolution.

The Resolution comes into force on April 1st.
