The National Civil Aviation Agency (ANAC) revised the regulatory framework for the exploration of aviation services, in line with the federal government program on the modernization of civil aviation legislation, namely “Voo Simples”.



The National Civil Aviation Agency (ANAC), through Resolution n.º 659/2022, revised the regulatory framework for the exploration of aviation services by Brazilian companies, revoking ANAC Resolution n.º 377/2016. The revision stems from the “Voo Simples” federal government program on the modernization of civil aviation legislation (see more in the 17th edition of the Regulatory Report), which is currently provided in the form of Provision Measure n.º 1.089/2021 (conversion into law requires the approval of the National Congress).

According to ANAC, the new resolution simplified the authorization process for the provision of aviation services, no longer requiring the approval of a grant by the Collegiate Board of Directors of ANAC, since that requirement was excluded from the Brazilian Aeronautical Code (Law n.º 7.565/1986) by the aforementioned provisional measure.

As provided in the second, third, and fourth articles of the new resolution, the authorization process still requires the conclusion of the appropriate certification procedures (when applicable), use of aircraft adequate to the proposed aviation service, disclosure of fiscal, labor, and social security regularity, and adherence to the technical and operational conditions required by ANAC.
