The National Land Transport Agency (ANTT) launched a public consultation on a draft resolution designed to establish administrative procedures for enabling railway concessionaries to conduct projects, such as construction projects, on areas under concession. The initiative comprises ANTT’s 2021-2022 Regulatory Agenda.



Public Audience n. 4/2021 from the National Land Transport Agency (ANTT) submitted to public consultation a draft resolution establishing the administrative procedures that federal railway concessionaries must follow in order to carry out projects, such as construction projects, on areas under concession, which are supervised by ANTT. The proposal also applies to sub-concessionaries and to third-party projects.

The proposed resolution establishes six categories of concessionary projects (PIC, in the Portuguese acronym for “projects in the interest of concessionaries”) and provides a classification for third-party projects (PIT, in the Portuguese acronym for “projects in the interest of third parties”).  The proposal seeks to provide specific ANTT authorization conditions and rules for PIC and PIT, as well as common provisions.
