The National Land Transport Agency (ANTT) updated and simplified the rules and procedures for concessionary transfers of concession and alterations in company control, applicable to all concession contracts under ANTT supervision.



Resolution n. 5.927/2021 from the National Land Transport Agency (ANTT) enacted new regulatory provisions on the transfer of concessions, transfer of concessionary company control, and other company control alterations, provided in article 1. The updated and simplified regulatory provisions established rules and procedures for conducting those concessionary transfers and alterations (concessionary operations), applicable to all concession contracts under ANTT jurisdiction.

The new resolution established which concessionary operations require previous ANTT approval (article 5) or post-fact ANTT validation (article 6). The procedure for requesting ANTT approval is detailed in articles 9 to 16, and an ANTT act of approval – an official act published in the Federal Official Gazette – is valid for one year (article 22). The post-fact ANTT validation process is described in articles 17, 18 and 19.
