The National Water and Sanitation Agency (ANA) submitted to public consultation, for a period of 45 days, a draft joint resolution with Brazilian Institute of the Environment and Renewable Natural Resources (IBAMA). The proposal establishes criteria for the delimitation of reservoir areas subject to backwater effects in environmental license procedures, applicable to new hydroelectric operations on watercourses under federal jurisdiction.



Public Consultation n. 4/2020 submitted a draft joint resolution proposal from the National Water and Sanitation Agency (ANA) and the with the Brazilian Institute of the Environment and Renewable

Natural Resources (IBAMA), applicable to new operations and facilities destined to hydroelectric production and the utilization of hydraulic potential of federal watercourses.

It establishes criteria for the delimitation of reservoir areas affected by backwater in environmental license procedures, seeking to improve precautionary measures and regulatory quality with regard to the reallocation of rural and urban areas and infrastructure.

ANA also produced a Regulatory Impact Analysis (RIA/AIR) for the draft resolution, identifying existing regulatory limitations, the goals of regulatory improvement, provisions for better coordination between ANA and IBAMA and the pros and cons of the suggested course of action.
