Regulatory Report


The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) submitted a revision of the Technical Regulation for the Measurement of Oil and Natural Gas (RTM) to public consultation. It seeks to balance metrological risks and regulatory costs in different output conditions.

The Foreign Trade Chamber (CAMEX) at the Ministry of Economy updated the lists of products under the regime of auto-parts not produced domestically, which grants import tariff benefits to qualified automotive companies.

The Ministry of Economy enacted an import tariff reduction for wind power generation sets (NCM 8502.31.00), in line with the ministry’s promotion of renewable energy sources in electricity generation.

Mainly related to wind power, the Federal Government regulated the cession of maritime areas and interior waters for offshore electric energy generation, and research and development activities. It seeks sustainable development goals and the exploration of its energy potential.

The Federal Government enacted the legal framework for distributed microgeneration and mini-generation, aimed at providing legal security and predictability to the fast-growing small-scale generation schemes.

The Ministry of Agriculture, Livestock and Supply (MAPA) submitted to public consultation a proposal to update the Brazilian National Plan for the Control of Residues and Contaminants for animal products (PNCRC/Animal, in the Portuguese acronym).

The National Agency for Waterway Transportation (ANTAQ) determined the development of transparency booklets, destined for users of maritime transportation services, on the application of extra freight charges and surcharges, seeking to improve transparency.

The Federal Government enacted the Cabotage Transport Stimulus Program, namely “BR do Mar”, intended to promote the availability and competitiveness of cabotage navigation in Brazil. New regulatory provisions were implemented.

The Federal Government postponed the validity of incentives from the Support Program for the Technological Development of the Semiconductor Industry (PADIS) until 2026 and added new products to the program, including components used in photovoltaic modules and panels.

The Ministry of Economy launched a public consultation intended to revise and consolidate the regulatory framework on import licensing. The proposal seeks to incorporate recent legal and regulatory developments and improve transparency and predictability.

The Federal Government enacted a new regulatory framework for the Brazilian National Solid Waste Policy (PNRS, in the Portuguese acronym), aimed at improving its implementation. Additionally, the National Program on Reverse Logistics was established.
