The Federal Government sanctioned a law that enables the implementation of free flow toll collection systems in federal highways under concession. While further regulation is required, the law also provided alternative schemes where free flow is not possible.



Law n. 14.157/2021, sanctioned by the Federal Government, amended the Brazilian Traffic Code (Law 9.503/1997) and Law n. 10.233/2001 in order to enable the implementation of free flow toll systems in federal highways under concession. Such systems will allow the improvement of toll collection for concessionaries, while improving the experience of regular users and daily commuters.

As provided in the first article of the new law, the Federal Government will further regulate the requirements for that implementation, including the possibility of alternative schemes for improving toll collection in federal highway concession whose contracts were established before the new law, and where free flow systems cannot be implemented.

According to the Ministry of Infrastructure, the new law fosters the modernization of highway infrastructure, in line with the “inov@BR” Federal Government program. More information is available in the 22nd and 23rd editions of the Regulatory Report.
