The Foreign Trade Chamber (CAMEX) at the Ministry of Economy revised the list of import tariff exemptions for the aerospace sector, seeking to align its provisions with the WTO’s plurilateral Agreement on Trade in Civil Aircraft.



The Foreign Trade Chamber (CAMEX) at the Ministry of Economy, through GECEX Resolution n.º 310/2022, revised the list of import tariff exemptions for the aerospace sector, revoking GECEX Resolution n.º 244/2021 – reported in the 28th edition of the Regulatory Report. According to the ministry, the revision intends to align the Brazilian import tariff schedule for aerospace products to the WTO’s plurilateral Agreement on Trade in Civil Aircraft, which Brazil is not a part of yet.

As provided in the first article of the new resolution, the list of tariff exemptions for the aerospace sector, as described in its Annex, now comprises Annex “III” of GECEX Resolution n.º 272/2021. The list is also available on CAMEX’s website. The import tariff exemptions now comprise:

  • Aircraft and other vehicles under HS headings 8802 and 8806 and their parts under HS heading 8807;
  • Flight training equipment and their parts (under HS subheadings 8805.21 and 8805.29); and
  • Products under 936 HS subheadings (e.g., parts and components) that are manufactured in accordance with the technical specifications and aviation rules and destined for the production, repair, maintenance, transformation, modification, or industrialization of aircraft and other vehicles and their parts.

Table 2 of the Annex of the new resolution also provides the reduction in import tariffs for 10 HS subheadings. Other conditions were also provided in the Annex.

Furthermore, CAMEX enacted GECEX Resolution n.º 306/2022, incorporating one aerospace product within the  Mercosur Common Nomenclature (NCM, in the Portuguese acronym) code “8903.99.00” and the NCM code “8801.00.00” to the list of exceptions to the Mercosur Common External Tariff (Annex “II” of GECEX Resolution n.º 125/2016), providing tariff exemptions.
