The Ministry of Economy provided an update to the federal authorization process on the establishment of foreign company branches in Brazil by foreign companies seeking to operate in the country without the legal establishment of an affiliated Brazilian company.

The Foreign Trade Chamber (CAMEX) at the Ministry of Economy updated the list of capital goods (BK) – GECEX Resolutions n.º 308/2022 and n.º 319/2022 – and computer and telecommunications goods (BIT) – GECEX Resolutions n.º 309/2022 and n.º 320/2022 – subject to the temporary exemption on import duties granted by the “ex-tariff” regime.

The Ministry of Economy enacted a new 10% reduction in import duties applied to capital goods (BK) and computer and telecommunication goods (BIT). As of April 2022, the cumulative 20% cut in import tariffs for such products intends to boost market competitiveness.

The Federal Government enacted a 25% reduction in the Tax on Industrialized Products (IPI, in the Portuguese acronym) for most domestically-produced and imported industrialized goods. It seeks to promote economic recovery in line with budget constraints.

The Federal Government enacted the 2022-2050 National Fertilizer Plan, seeking to reduce the Brazilian dependency on imported fertilizers, currently supplying more than 80% of demand. Among its goals, the plan aims to improve business and innovation environments and logistics infrastructure related to fertilizers.

The National Civil Aviation Agency (ANAC) established a new framework for the monitoring of concession-bound assets, applicable to airport infrastructure concessionaires. It is designed to improve the quality of information available to ANAC.

The National Civil Aviation Agency (ANAC) revised the regulatory framework for the exploration of aviation services, in line with the federal government program on the modernization of civil aviation legislation, namely “Voo Simples”.

The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) launched a public consultation on the revision of the regulatory framework on incident reporting, transversally applied to the regulated market.

The National Monetary Council (CMN) and the Central Bank of Brazil (BCB) enabled the use of foreign currency in domestic bank accounts titled to E&P companies for the purpose of carrying out the decommissioning of installations at conceded oil and natural gas fields.

The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) enacted new rules for E&P investment obligations in RDI activities. They comprise company programs in priority segments and the prioritization of specific topics of innovation.

The Brazilian Health Regulatory Agency (ANVISA) revised the list of UV filters added for skin protection permitted for personal hygiene products, cosmetics, and fragrances. It incorporated a MERCOSUR resolution to the Brazilian regulatory framework.
